Every appeal is unique — the charged offense, the evidence used at trial, the rulings of the judge, and actions of the trial attorneys. Rather than investigating and offering evidence in court, an appellate attorney reviews the trial transcript and court records below to determine what happened in the trial court. An appellate attorney works to find errors in the proceedings below that may provide a legal basis for reversing the conviction for an acquittal or a new trial/hearing. Thereafter, the appellate attorney researches and writes a specialized document – a brief – to one of Texas’ several appellate courts to challenge the conviction and sentence.
